Terms & Conditions:
1. Information on how to claim forms part of these terms and conditions. Offer not valid in conjunction with any other offer.

2. Offer is only open to New Zealand residents. Employees and their immediate families of the Promoter, participating retailers and their agencies associated with this promotion are ineligible.

3. Promotion opens 1 November 2008 and closes 31 January 2009 (“Promotion Period”). All claims must be received by last mail on 16 February 2009.

4. Claimants must purchase a specially marked pack of either an official version of Dragon NaturallySpeaking 10 (Standard, Preferred, Preferred Mobile or Preferred Wireless editions) to be eligible to claim one (1) remote-controlled helicopter (“RC Helicopter”). Claimants will receive the RC Helicopter via post. (Note: batteries are not included with RC Helicopter).

5. Offer is limited to one claim per product purchased. Each claim must be made via the online claim site or via an official claim form, be accompanied by a copy of the receipt verifying purchase of the relevant product during the Promotion Period and the barcode from the packaging of the product and be posted in a stamped envelope to: “PO Box 64142, Botany Downs, Manukau 2142, New Zealand.”

6. Please allow 6-8 weeks from receipt of the claim form by the Promoter for delivery of RC Helicopter.

7. The Promoter reserves the right to verify the validity of all claims and disqualify any claimant for tampering with the claim process or for submitting a claim, which is not in accordance with these terms and conditions.

8. The Promoter accepts no responsibility for late, lost or misdirected mail and/or claims.

9. The RC Helicopter is valued at AUD$29.95. The value is the recommended retail value as provided by the supplier and is correct at the time of printing. The Promoter does not accept any responsibility for any changes in the RC Helicopter value.

10. The Promoter does not accept any responsibility if the RC Helicopter is lost or damaged in transit. If the RC Helicopter or any element of the RC Helicopter is unavailable for any reason (including but not limited to unavailability, loss or damage), the Promoter reserves the right to award in lieu a similar item to the equal recommended retail value, subject to applicable legislation.

11. The RC Helicopter cannot be transferred, exchanged or taken as, or redeemed for, cash.

12. EXCEPT FOR ANY LIABILITY WHICH CAN NOT BE EXCLUDED BY APPLICABLE LAW, THE PROMOTER SHALL NOT BE LIABLE FOR ANY ACTUAL OR PROSPECTIVE LOSS OR DAMAGE SUFFERED (INCLUDING BUT NOT LIMITED TO INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS) OR FOR ANY PERSONAL INJURY, DEATH OR DAMAGE TO REAL OR TANGIBLE PROPERTY SUFFERED OR SUSTAINED (INCLUDING THROUGH NEGLIGENCE) IN CONNECTION WITH OR ARISING FROM THE PROMOTION OR THE USE OF THE RC HELICOPTER. THE CLAIMANT SHALL BE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR THE SAFE OPERATION OF THE RC HELICOPTER IN ACCORDANCE WITH ITS INSTRUCTIONS. PROMOTER’S MAXIMUM LIABILITY FOR CLAIMS ARISING UNDER OR RELATED TO THIS PROMOTION INCLUDING BUT NOT LIMITED TO THOSE EITHER DIRECTLY OR INDIRECTLY RELATED TO THE RC HELICOPTER SHALL, IN ALL INSTANCES, BE LIMITED TO THE RECOMMENDED RETAIL VALUE OF THE RC HELICOPTER.

13. THE PROMOTER DOES NOT GIVE ANY WARRANTY OR GUARANTEE WITH REGARD TO THE RC HELICOPTER INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE RC HELICOPTER TO BE SUPPLIED IS PROVIDED “AS IS”.

14. By making a claim, unless otherwise advised by the claimant in writing, each claimant consents to the information they submit with their claim being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the claimant. All personal details of the claimants will be stored at the office of the Promoter. A request to access, update or correct any information should be directed to that office.
